If you are a New Jersey healthcare provider and you treat victims of automobile accidents, you are certainly familiar with the numerous technical and procedural hurdles involved in getting appropriate Personal Injury Protection (PIP) reimbursement from No-Fault insurers. You also undoubtedly have extensive dealings with the personal injury attorneys that represent your patients for their injury claims.

While these attorneys may do a terrific job representing their clients (your patients), they likely know very little of the myriad of technical issues that can affect whether you receive the correct amount of PIP reimbursement. Questions about coding, pre-certification, cross-walking, multiple procedure reductions, fee schedules, etc., are outside of their expertise and are often viewed as being not worth the time and effort to properly address. If your bills are ultimately disputed in a legal proceeding, an attorney’s lack of knowledge and/or concern for the nuances of PIP could easily lead to your bills being greatly reduced or denied outright.

You are free to choose your own attorney to represent you for the recovery of PIP benefits. If you have an assignment of benefits signed by the patient, you have the right to retain an attorney of your choice to pursue collection of PIP benefits on your behalf.

Even if a patient’s attorney issues you a letter of protection, he or she may ask you to compromise your bills in an effort to maximize the amount of money that his or her client receives from a settlement. Again, the primary interest of the patient’s attorney is making sure the client walks away with the most money in his or her pocket, a focus which doesn’t necessarily translate into your practice maximizing its recovery from the PIP carrier.

For over a decade, the attorneys at the Costello Law Firm have cultivated a practice focused on healthcare providers and specializing in recovering the maximum amount of PIP benefits for our clients. The Costello Law Firm represents numerous healthcare providers in a variety of specialties throughout the Southern New Jersey, including orthopedists, physiatrists, pain management physicians, spinal surgeons, chiropractors, physical therapists, diagnostic imaging centers, ambulatory surgical centers, providers of durable medical equipment, as well as the largest urgent care hospitals in the region.

For medical providers that choose to retain the Costello Law Firm, we will provide the following services:

1. Review your patient files to assess whether there are underpaid benefits, improperly assessed penalties, and/or unreasonable denials of services on a medical necessity basis;

2. If we identify any files where additional reimbursement is available, we will file the appropriate Internal Appeals requests to the insurers on behalf of your office.

3. If any disputed bills are not resolved through the Internal Appeals process, we will file a Demand for NJ No-Fault (PIP) Arbitration on your behalf against the insurance company to recover those bills

4. Provide consulting services and advice regarding pre-certification and compliance with No-Fault insurers’ Decision Point Review and Internal Appeals processes to maximize your PIP reimbursement going forward, without the need to resort to litigation.

All of the above services would be provided at no cost to you. If we are successful in recovering outstanding PIP payments on your behalf through litigation or settlement, as per New Jersey law, the insurance company is responsible to pay our fees and costs.

We will be happy to review closed accounts, as there may have been reductions made to your bills that are difficult to identify without extensive familiarity with the New Jersey PIP rules and regulations. We have successfully reviewed older EOBs, identified improper reductions and have recovered additional amounts on bills that medical providers had written off as paid in full.
